Feelin’s Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Feelin’s mobile application and any related websites or services (collectively, the “Platform”) operated by Bragright Technologies PVT LTD (“Company”, “we”, “us”, or “our”). By accessing or using Feelin’s (the “App”), you (“you” or “your”) agree to be bound by these Terms. Please read these Terms along with our Privacy Policy and any Community Guidelines (collectively, the “Platform Policies”), which together form a legally binding agreement.
1. INTRODUCTION
Acceptance: By using our Platform, you confirm that you have read, understood, and agreed to these Terms.
Amendments: We may periodically update these Terms. Continued use of the Platform after changes implies your acceptance of the updated Terms. Please review this page regularly.
Governing Law & Jurisdiction: These Terms shall be governed by and interpreted according to the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the Courts of Bangalore, Karnataka.
2. WHO MAY USE FEELIN’S
Eligibility: You must be at least 18 years old—or the age of majority in your jurisdiction if higher—and legally capable of entering a binding contract. If you register on behalf of a company or legal entity, you represent that you have the authority to bind that entity.
Registration: Use of the Platform requires you to register with your phone number and authenticate via a One-Time Password (OTP) sent to your device. You agree to provide accurate, current, and complete information during registration and in connection with your use of the Services.
3. SERVICES AND CONTENT
A. Platform Services
Description: Feelin’s is a social platform that allows you to communicate with Buddies, share content (including images, videos, and text), and participate in various interactive and promotional features (such as games, broadcasts, and rewards).
Modifications: We may add or remove functionalities and update our Services at our discretion without prior notice. If a change requires your explicit consent, we will ask for it.
B. Content and Intellectual Property
Your Content: When you upload or share content on Feelin’s, you retain ownership of your content. However, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content in connection with the operation and promotion of the Platform.
Member Content: You acknowledge that content provided by other users is their property. You must use such content only in a manner consistent with Feelin’s purpose and guidelines.
Our Content: All content, design, software, and intellectual property associated with the Platform are owned or licensed by Bragright Technologies PVT LTD. You are granted a limited, non-transferable license to access and use such content solely for personal and lawful purposes.
4. PURCHASES, VIRTUAL CURRENCY, AND DIGITAL GOODS
A. Virtual Currency (“Gold”) and Gifts
- Acquisition and Use: You may purchase Gold using available payment methods. Gold can be used within Feelin’s to access games, customize your profile, or gift digital items (“Gifts”) to other users.
- Non-Transferability: Gold and Gifts are non-cashable, non-transferable, and cannot be exchanged or redeemed for monetary value.
- Expiry: Gold will expire and be automatically forfeited if not used within six (6) months (182 days) from the date of purchase. No refunds or credits will be provided for unused Gold.
- Pricing & Refunds: The price of Gold is displayed at the point of sale, inclusive of applicable taxes. Once the transaction is complete, payments are final and non-refundable.
B. Third-Party Payment Processing
- Payment Methods: You agree to pay any applicable charges for Gold or In-App Purchases using the provided third-party payment processors.
- Refund Policy: In-App Purchases are generally nonrefundable; please review any additional payment terms provided during your transaction.
5. USER COMMITMENTS
A. Account Security and Authenticity
- Registration Integrity: You must provide truthful information during registration and maintain the security of your account credentials. You are responsible for all activities conducted through your account.
- No Impersonation: You may not impersonate any individual or entity or provide false information about your identity. Any breach may result in suspension or termination of your account.
B. Appropriate Use and Community Conduct
- Respect & Privacy: You agree to respect the privacy and rights of other users. Do not share content that you do not have permission to distribute or that violates the rights of any third party.
- Prohibited Conduct: You shall not use the Platform for unlawful activities, spreading misinformation, harassment, hate speech, or any behavior that is abusive, discriminatory, or incites violence.
- Security Restrictions: You must not attempt to interfere with, disrupt, or undermine the integrity of the Platform (including using bots, engaging in data scraping, or introducing malware).
C. Third-Party Links and Materials
External Content: Feelin’s may feature links to third-party websites, content, or services for your convenience. Such content is not under our control, and you use it at your own risk. Refer to those third parties’ policies for information on their practices.
6. PERMISSIONS AND LICENSES
Content License: By posting content on Feelin’s, you grant us the right to host, use, modify, distribute, and display your content as necessary for operating the Platform and promoting our Services.
Automatic Updates: You consent to receiving automatic updates to the App. It is your responsibility to install the latest versions to continue accessing our Services.
7. DISCLAIMER AND LIMITATION OF LIABILITY
Disclaimer: The Platform and Services are provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free operation and expressly disclaim all implied warranties to the fullest extent permitted by law.
Limitation of Liability: In no event shall Bragright Technologies PVT LTD or its affiliates be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of your use of, or inability to use, the Platform—even if advised of the possibility of such damages. If any provision is found unenforceable, our aggregate liability shall not exceed Rs 10,000 or the amount you paid in the past 12 months whichever is lower.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Bragright Technologies PVT LTD, its officers, directors, employees, affiliates, and agents from any claims, damages, or expenses (including legal fees) arising from:
- Your use of the Platform.
- Any breach of these Terms.
- Any violation of applicable law or infringement of any rights by your content.
This obligation shall survive termination of your account.
9. DISPUTE RESOLUTION
Mediation and Arbitration: The parties agree to first attempt to resolve disputes through good faith mediation. If unresolved, disputes will be submitted to arbitration under the Indian Arbitration and Conciliation Act, 1996, held in Bangalore, and conducted in English.
Class Actions: You agree not to participate in any class action lawsuits against us.
10. TERMINATION AND SUSPENSION
Termination by You: You may terminate these Terms by deleting your account from the Platform. However, past transactions and accrued rights will remain subject to these Terms.
Termination by Us: We reserve the right to suspend or terminate your access to the Platform at our sole discretion, including for any violation of these Terms or applicable law.
Surviving Provisions: Termination of your account will not affect any provisions intended to survive (e.g., intellectual property rights, indemnification, dispute resolution).
11. GRIEVANCE REDRESSAL
Should you have any questions, complaints, or claims regarding the Platform or these Terms, please contact us at grievance@feelins.app. Our designated Grievance Officer will acknowledge your inquiry within 24 hours and strive to resolve the issue within 15 days.
12. MISCELLANEOUS
- Assignment: These Terms are personal to you and may not be assigned or transferred without our prior written consent. We may assign or transfer our rights and obligations under these Terms without your consent.
- Notices: We may send notices or other communications electronically (e.g., via email or in-app messages). Such communications are deemed effective 3 days after transmission.
- Entire Agreement: These Terms, together with our Privacy Policy and any additional guidelines, constitute the entire agreement between you and us, superseding all prior agreements.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- Language: In the event of any conflict between translations and the English version, the English version shall prevail.
13. CHILD, WOMEN, AND VULNERABLE USERS SAFETY POLICY
We are committed to ensuring a safe and respectful environment on Feelin’s. In addition to complying with all applicable laws, we enforce the following policies:
A. Zero Tolerance and Legal Compliance
- Child Safety: We strictly prohibit any content or behavior that exploits, endangers, or abuses minors. In accordance with the Protection of Children from Sexual Offences (POCSO) Act, 2012, any content involving the sexual exploitation of minors is immediately subject to removal and may result in immediate account suspension or termination.
- Women and Vulnerable Groups: We enforce a zero-tolerance policy toward any abuse, harassment, or exploitation directed at women or any other vulnerable groups. Content that is discriminatory, harassing, or promotes hatred will be removed, and users engaging in such behavior may face immediate suspension or termination.
B. Reporting, Enforcement, and Safety Measures
- Reporting Mechanism: Users are encouraged to report any content or behavior that violates this policy via the in-app reporting feature or by emailing support@feelins.app. We will take such reports seriously and act promptly.
- Enforcement: Violations of this policy may result in account suspension, permanent banning, and, where appropriate, reporting to law enforcement authorities.
- Safety Features: Our Platform employs content screening and human moderation to detect and remove prohibited material. We also incorporate age verification whenever deemed necessary.
C. Tolerance and Respect
Promoting a Positive Community: We value tolerance and respect for diversity. All users are expected to interact in a manner that is respectful of others, regardless of gender, age, religion, caste, or ethnicity. Unlawful or hateful behavior will not be tolerated.
